Key updates include a requirement for non-decentralized DeFi protocols, those effectively controlled in practice, to register with the CFTC. The DeFi-related rules would apply specifically to spot crypto trading. 

The draft also clarifies credit unions' authority to engage with crypto. Notably, sections covering ethics provisions, BRCA, and stablecoin yield were left unchanged, which is where much of the remaining disagreement sits.

Industry reaction has been active but mixed. Coinbase CEO Brian Armstrong told CNBC that the bill is close to securing enough Senate support, with remaining disagreements largely centered on ethics provisions.

Is the CLARITY Act Really Dead If the 60-Vote Fails?

Not necessarily. Even sources close to the process say negotiations would likely continue past September 15. Blockchain Foundation's Cleve Mesidor has said the effort isn't dead even if the procedural vote stumbles. Industry groups, including the Digital Chamber, have floated the idea of slimmed-down versions of the bill attaching to unrelated must-pass legislation before year-end.

Proposed transfer-agent rules would let blockchains serve as official ownership records for issuers. On the derivatives side, the CFTC has opened regulated pathways for crypto perpetual futures through platforms like Kalshi and Coinbase. 

CLARITY still matters because only Congress can permanently divide oversight between the SEC and CFTC, but its failure wouldn't halt progress elsewhere.
