Former Fox Business journalist Eleanor Terrett recently revealed that seven Senate Democrats are “committed to working in a bipartisan fashion” to pass the CLARITY Act. The group includes Senators Gillibrand, Warner, Gallego, and Alsobrooks.
Three sources familiar with the discussions told Terrett that both sides are already gauging appetite for returning to the table before the end of the year. The statement came hours after the same seven senators voted against the bill on the Senate floor.
Senators Kirsten Gillibrand, Angela Alsobrooks, Cory Booker, Catherine Cortez Masto, Ruben Gallego, Mark Warner, and Raphael Warnock issued a joint statement after the vote. They called the result “a setback, but not the end of that important work.”
They described two years of effort toward legislation that would “expand opportunity, protect consumers, punish bad actors, create regulatory certainty, and include strong, commonsense ethics provisions for elected officials.” They closed by reaffirming their commitment to passing the bill as bipartisan.

The CLARITY Act failed on September 15. It received 49 yes votes against 50 no votes. Republicans failed to get the 60 required votes to advance the bill, with all Democrats voting against it.
As Democrats requested, Republicans made 126 significant changes, Donald Trump agreed to ethics provisions, and a 635-page substitute bill was released days before the vote. Democrats did not take that bill, but submitted a last-minute counter-offer on the morning of the vote, which Republicans rejected.
Senator Lummis responded publicly. She said she sat at the table with Senate Democrats working in good faith while they played games. She accused them of handing foreign competitors an advantage. Listing what Democrats voted against, she wrote, “limits on politicians’ personal crypto investments, consumer protections, and American leadership in digital assets.”

The community did not take kindly to this revelation, with many threatening to vote out the Democrats. One commenter argued that they could have negotiated and passed the bill the last time if they wanted to. Another reminded the community that they made similar promises and statements in 2025.
Senator Lummis warned that a failure in this Congress could delay market structure legislation until 2030. If Democrats win the House majority in November, passing this bill in the next Congress becomes considerably harder. The seven Democrats have now stated their position publicly, and Terrett suggests early efforts to resume negotiations have begun.
