Crypto commentator BankXRP (@BankXRP) shared remarks from SEC Commissioner Hester Peirce confirming the agency will advance crypto rulemaking with or without the CLARITY Act. Peirce laid out a concrete agenda, and her comments carry significant weight for XRP holders watching the Senate.

Peirce Lays Out the SEC’s Agenda

Peirce confirmed the SEC has substantial crypto work ahead. She said the agency will work on “issues like custody, trading of tokenized securities, and all kinds of questions about how the existing rules interact with crypto.” She also named fundraising as a priority, noting the SEC can “develop a framework for people who are trying to do fundraising using crypto assets.”

Her position aligns with SEC Chair Paul Atkins, who previously stated that the agency is ready, willing, and able to make rules. Peirce echoed that directly. She said the chairman “is absolutely right that we will work hard either way.”

Legislation Remains the Preferred Path

Peirce expressed optimism the CLARITY Act will pass. The bill would give “the industry and investors and regulators an easier path forward,” she said, because it establishes very clear lines about who has authority over the crypto spot market.

The CLARITY Act draws a legal distinction between digital assets classified as commodities and those classified as securities. It assigns regulatory jurisdiction to either the SEC or the CFTC depending on the asset.

For XRP, which already has established regulatory clarity following its legal battle with the SEC, a clear statutory framework could reinforce its position and expand the legal certainty institutional investors need.

The Senate Clock Is Running

The CLARITY Act has 51 confirmed votes in the Senate. It needs 60 to clear the filibuster. The Senate departs for recess on August 8. The bill has not been scheduled for a floor vote. Senate Majority Leader John Thune has prioritized other legislation, and no cloture filing has been publicly confirmed.

If the Senate does not act before recess, the bill moves to September at the earliest. Recent reports suggest 7 to 10 Democrats are ready to support the bill. However, the Senate must still schedule a vote.

What It Means for XRP and the Market

Clarity would remove friction for institutional adoption of XRP and crypto technology. The SEC’s commitment to advancing crypto rules independently is significant following years of aggressive enforcement. Agency rulemaking can move faster than legislation, and the SEC is ready to step in regardless of the CLARITY Act’s outcome.
