Crypto researcher SMQKE (@SMQKEDQG) posted a breakdown of a major development around the CLARITY Act, catching the attention of XRP holders and crypto market participants.
SMQKE noted that Senate Majority Leader John Thune had filed cloture on the CLARITY Act, ensuring the Senate will vote on the bill when members return from recess in September.
Thune’s Filing
Before lawmakers left Washington, Thune filed cloture on the motion to proceed to Calendar #423, H.R.3633. Thune had indicated plans to make this move ahead of recess, and he delivered on that commitment. The filing does not pass the bill, but guarantees that the Senate must address it in September.
Grok’s Analysis
SMQKE also shared an analysis from Grok. The chatbot explained the mechanics behind the filing in simple terms. Grok described cloture as a procedural tool that ends a filibuster, preventing further delays. Filing it on the motion to proceed triggers a vote in approximately two session days on whether the Senate takes up the bill at all.
That vote requires 60 yes votes, and the bill currently has 51 confirmed votes. If it passes, the CLARITY Act moves to the floor for full debate and a final vote, with no filibuster option remaining. Recent reports suggest up to 10 Democrats have shown support, meaning the bill may have the 60 votes it needs.
Thune’s filing puts every senator on record and forces the chamber to act when it reconvenes. The bill cannot simply be sidelined when the Senate returns.
The Importance of the CLARITY Act
The CLARITY Act is a bill that sets rules for crypto markets and clarifies the division of oversight between the SEC and the CFTC. It has been a central priority for the crypto industry throughout 2026. SMQKE highlighted that Thune’s action removes the risk of filibuster tactics that could delay the legislation further.
XRP holders in particular have followed the bill’s progress closely, given how directly the legislation could impact institutional adoption.
All Eyes Are On September
Two unresolved issues will dominate negotiations during the recess period. Former Fox Business journalist Eleanor Terrett recently revealed that a group of banks has successfully lobbied several Republican senators to push for changes to yield-related language in the bill.
On the Democratic side, the sticking point remains a demand that state attorneys general hold the power to take legal action against the DOJ over ethics enforcement. Republicans and the White House have both rejected that provision. Both sides now have the recess to find common ground.
Senator Cynthia Lummis stated her position clearly before the break. “We’ve come too far to quit now,” she said. Thune’s filing ensures the Senate holds to that promise when September arrives.
