Democrats Eye a Broader Package in the Next Congress

Latest news from Washington shows House Democrats are discussing a crypto market structure bill. It would go to the next Congress, which starts in January 2027. The plan would turn Rep. Maxine Waters’ 2025 consumer rights amendment into a wider package.

Journalist Eleanor Terrett X Post

Journalist Eleanor Terrett broke the story in an X post on November 4, 2026. She cited three industry sources who spoke with Democratic staffers. No draft text or official announcement exists yet. The details are preliminary.

What the Draft Could Change for the SEC and CFTC

The House passed the CLARITY Act (H.R. 3633) in July 2025 by 294 to 134. It would split oversight between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC).

The Senate stalled it after a cloture vote failed in September 2026. That vote needed 60 votes to start debate.

Rejected Waters amendments plus Senate talks

Terrett’s sources say Democrats want the SEC to watch digital asset markets more closely. They want the CFTC to play a smaller part. A crypto market structure bill built that way would reverse the House-passed design. It would also reopen CFTC oversight debates over who polices spot trading.

How the Waters Consumer Protections Could Return

Waters proposed the Crypto Investor and Consumer Bill of Rights in July 2025. It was amendment 31 to H.R. 3633. The House Rules Committee blocked it in a 4-8 party-line vote. Reported provisions focus on investor protection:

  • 24/7 customer service

  • Insurance or SIPC-like coverage

  • Fiduciary and best-execution rules

  • Anti-front-running rules

  • Bankruptcy-remote custody of customer assets

  • 24-hour withdrawal processing

  • Monthly auditor-attested proof of reserves

  • More funding for the SEC and CFTC

Terrett says the new draft would also add other Democratic amendments that were not adopted. It would include terms Senate Democrats reached with Republicans before the failed vote. Waters’ statements and related materials are on the site of House Financial Services Committee Democrats.

Why Ethics Rules for Officials Are Back on the Table

Terrett adds that more ethics rules are likely. They would limit the digital asset dealings of President Trump and other federal officials. This echoes the Stop TRUMP in Crypto Act (H.R. 3573). Waters and committee Democrats introduced it in May 2025, according to the committee press release.

The one-page summary says the act would bar the president, vice president, members of Congress and their immediate family from issuing, sponsoring or promoting digital assets.

It would also bar them from serving as officers or owners of issuers. They could not trade in the office while holding material non-public information.

Outlook for the Crypto Market Structure Bill in 2027

Republicans call the effort a messaging bill. That means more political signal than likely law. Still, Democratic gains in the November 2026 midterms give the party more leverage in the new Congress. Any crypto update on draft text would show how far the plan has moved.

The crypto market structure bill is still an early idea. No text exists. The report rests on three anonymous sources, so details may change as the new Congress organizes.

Its fate may hinge on one test: can an SEC-led model win the 60 Senate votes that CLARITY lacked.
