The Clarity Act, the most significant crypto legislation in U.S. history, is facing a political roadblock that has nothing to do with the bill’s substance.
Anthony Scaramucci, former White House Communications Director, just delivered a stark warning. He said Democrats will vote against the Bitcoin Clarity Act purely because they hate Trump.
“They will do everything they can to block it because he wants it,” Scaramucci said. “When they get back in power they’ll pull a Gensler and it will be very, very bad for the industry.”
He put the odds of passage at roughly 40% . The message was clear: Democrats are putting party over country. They are trying to kill the bill.

John E. Deaton, the pro-XRP lawyer who represented 75,000 XRP holders as amicus counsel in the SEC case, responded to Scaramucci’s warning. He said Scaramucci is 100% correct.
Deaton wrote: “The Democrats don’t want to give Trump a win. Period. It’s utter bullshit to claim their opposition is over ethics.”
He acknowledged that he is not a Trump guy: “Everyone knows I’m not a Trump guy. But I love my country.”
His conclusion was blunt: “They simply hate Trump more than they love America. And it’s both tragic and pathetic.”
Deaton pointed out that Trump has already made $1.4 billion in crypto without the Clarity Act. He will continue to make money off crypto whether the bill becomes law or not. The opposition is not about ethics or policy. It is about denying Trump a legislative victory before the midterms.

What This Means for the Clarity Act
Scaramucci’s 40% odds are a significant big from the optimism that had been building around the bill. The Clarity Act passed the Senate Banking Committee in May and has been on the Senate calendar since June. The ethics provision was the last major hurdle, and Trump agreed to it.
But politics is now the obstacle. Democrats are reportedly opposed to giving Trump a win, especially ahead of the midterm elections. The bill needs 60 votes to pass the Senate. Without Democratic support, it cannot advance.
The Clarity Act would provide a federal regulatory framework for digital assets, ending the “regulation by enforcement” approach that has dominated U.S. crypto policy. Its failure would be a major setback for the industry.
All in all, Scaramucci and Deaton are making a point that is hard to ignore. The Clarity Act has been negotiated for months. The ethics provision was resolved. The bill text is ready. Yet the vote is still not happening.
The only remaining obstacle is politics. Democrats do not want to give Trump a win, I believe this is true as well.
For the crypto industry, this is devastating. The Clarity Act would provide the regulatory clarity that institutions are waiting for. Without it, the U.S. risks falling behind other jurisdictions like the EU, which already has MiCA.
Deaton is right: this is tragic and pathetic. The industry has been fighting for years for clear rules. Now the bill is being held hostage by partisan politics.
