Thailand has finalized its regulatory framework for cryptocurrency exchange-traded funds, opening the door for domestic $BTC and $ETH products to trade on a regulated exchange for the first time.
Framework Takes Effect October 16
Thailand's Securities and Exchange Commission issued 11 notifications on October 8, 2026, setting out the rules for how crypto ETFs will operate in the country. The framework takes effect October 16, 2026, with trading limited to the Stock Exchange of Thailand. Asset managers, however, must still obtain individual SEC approval before launching any products under the new rules.
Initially, only spot-linked Bitcoin and Ether ETFs are permitted. Foreign-ETF-linked products such as depositary receipts are not allowed at launch.Brokers are also prohibited from assisting retail investors in purchasing foreign ETFs, though institutional and ultra-high-net-worth investors are exempt.
ETFs must be structured as passive vehicles tracking a single cryptocurrency, with at least 80% average net exposure to that asset over each accounting year.The SEC also modified rules for local market participants, allowing domestic mutual funds and private funds to invest in Thai-based crypto ETFs. Previously, such investments were limited to offshore crypto ETF offerings.
Investor Protections Built Into The Rules
Investors will need to receive risk information and confirm understanding before trading. Suitability checks and mandatory risk disclosures are part of the framework, aiming to ensure retail participants understand what they are buying before committing capital.
Brokers are barred from providing margin loans to buy crypto ETFs, and ETF fund assets must be held with SEC-regulated digital asset custodians. The requirement for locally supervised custodians and exchange-only trading is designed to keep the entire investment chain within Thailand's regulatory perimeter.
Thailand joins a growing group of jurisdictions that have incorporated spot cryptocurrency ETFs into conventional securities markets, following launches in the United States, Hong Kong, Canada, and Australia.The SEC stated that feedback from consultations held earlier in the year favored the proposed framework, with market participants largely welcoming greater accessibility to digital assets through regulated channels.
